These Terms of Service ("Terms") constitute a legally binding agreement between you and CalFriendly LLC ("Company," "we," "us," or "our"). By downloading, installing, or using the CalFriendly mobile application, you confirm that you have read, understood, and agree to be bound by these Terms.
CalFriendly is a food and nutrition tracking application that enables users to log meals, look up nutritional information, track macronutrients, receive AI-generated nutritional estimates, and set dietary goals. The Application is provided on an "AS-IS" and "AS-AVAILABLE" basis.
You must be at least 18 years of age to use the Application. By using the Application, you represent and warrant that you meet this requirement.
This Application is not a medical device. All nutritional data, AI-generated food analyses, calorie estimates, sugar alerts, and health indicators are provided solely for general informational and self-tracking purposes. Nothing in the Application constitutes medical advice, clinical nutrition advice, diagnosis, or treatment.
AI Scan Accuracy. AI-generated nutritional estimates are approximations only. Calorie counts and macronutrient values may be inaccurate due to variables including food presentation, photo angle, lighting, portion size, and the inherent limitations of AI technology. Do not make health or dietary decisions based solely on AI scan results.
Consult a Professional. Always consult a licensed physician, registered dietitian, or other qualified healthcare professional before making dietary changes, especially if you have a medical condition including diabetes, hypertension, kidney disease, eating disorders, or if you are pregnant or breastfeeding.
Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase. Any unused portion of a free trial will be forfeited upon purchasing a subscription.
Cancel anytime through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. Deleting the Application does not cancel your subscription.
All sales are final except as required by applicable law. Refund requests for App Store purchases must be submitted directly to Apple. Refund requests for Google Play purchases must be submitted directly to Google.
The Application and all its content, features, and functionality are owned by CalFriendly LLC and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes only.
Your use of the Application is governed by our Privacy Policy, which is incorporated into these Terms. Please review it to understand our data practices.
You agree not to: reverse engineer or decompile the Application; use the Application for any commercial purpose without our written consent; attempt to gain unauthorized access to any part of the Application; use the Application in any way that violates applicable laws.
THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR SUITABILITY OF ANY NUTRITIONAL INFORMATION PROVIDED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CALFRIENDLY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APPLICATION SHALL NOT EXCEED THE GREATER OF $50 USD OR THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
Canadian Users: Nothing in these Terms limits any rights you may have under applicable Canadian provincial or federal consumer protection legislation, including the Consumer Protection Act (Ontario) and similar provincial statutes.
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive your right to participate in class action lawsuits. This arbitration clause does not apply to users in Quebec or other jurisdictions where such clauses are unenforceable.
We reserve the right to modify these Terms at any time. We will provide notice of material changes via in-app notification or email at least 14 days before the changes take effect. Continued use of the Application after that date constitutes acceptance.
